Town of Putnam Valley Local Law No. ___ of 2023

A Local Law Amending the Town of Putnam Valley Town Code Relating to Mooring Registration in All Special Districts

BE IT ENACTED, by the Town Board of the Town of Putnam Valley, Putnam County, New York, as follows:

Part 1. Title

This Local Law shall be known as the “A Local Law Amending the Town of Putnam Valley Town Code Relating to Mooring Registration in All Special Districts”

Part 2. Enactment

This Local Law is adopted and enacted pursuant to the authority and power granted by §10 of the Municipal Home Rule Law of the State of New York.

Part 3. Amendment of the Town Code

The Town of Putnam Valley Code §100-52 (A) is amended as follows:

Repeal & Replace

§100-52: Moorings

  1. All moorings must be registered with the Putnam Valley District Clerk. Applicants must first receive and furnish documentation of receipt of all current approvals from the New York State Office of Parks, Recreation & Historic Preservation (OPRHP). Upon receipt of the Town application form, a numbered registration tag will be issued by said Clerk which shall be affixed to the mooring buoy.
    1. Proof of residency within the District shall be required prior to the issuance of such identification tag.
    1. Acceptable proof of residency shall consist of a current tax bill and utility bill (cable or electric only).

Part 4. Severability

The invalidity of any part or provision (e.g., word, section, clause, paragraph, sentence) of this Local Law shall not affect the validity of any other part of this Law which can be given effect in the absence of the invalid part or provision.

Part 6. Supersession

This Local Law is intended to supersede any provisions of the Town Law, the laws of the Town of Putnam Valley, and the New York State General Municipal Law which are inconsistent with the provisions of this Local Law.

Part 7. Effective Date

This Local Law shall take effect immediately upon the filing with the Office of the Secretary of State of the State of New York, in accordance with the applicable provisions of law, and specifically, Article 3, Section 27 of the New York State Municipal Home Rule Law.

NOTICE OF ADOPTION FOR THE TOWN OF PUTNAM VALLEY

LOCAL LAW’S #1 and 2 OF 2023

PLEASE TAKE NOTICE that the Town Board of the Town of Putnam Valley adopted the following Local Laws at the Regular Town Board Meeting held on February 15, 2023.  (Laws can be found in their entirety on the Town’s website – Townofputnamvalley.gov).

  1. Local Law #1 of 2023 to amend Article I of Chapter 108 of the Town Code of the Town of Putnam Valley by Increasing the Income Threshold of the Senior Citizen Property Tax Exemption.

Town of Putnam Valley Solar and Wind Energy Real Property Tax Exemption Opting Out Law of 2023

BE IT ENACTED, by the Town Board of the Town of Putnam Valley, Putnam County, New York, as follows:

Part 1. Title

This Local Law shall be known as the “Town of Putnam Valley Solar and Wind Energy Real Property Tax Exemption Opting Out Law of 2023”

Part 2. Enactment

This Local Law is adopted and enacted pursuant to the authority and power granted by §10 of the Municipal Home Rule Law of the State of New York.

Part 3. Amendment of the Town Code

Chapter 108: “Taxation” of the Town of Putnam Valley Code is amended as follows:

Add

Article IV: Solar and Wind Energy Systems Exemption Opt-Out

§108-35: Short Title

This article shall hereafter be known as the “Town of Putnam Valley Solar and Wind Energy Real Property Tax Exemption Opting Out Law of 2023.”

§108-35: Legislative Intent

Section 487 of the state Real Property Tax Law grants a fifteen-year exemption from real property taxation of the increase in assessed value attributable to the construction or installation of qualifying solar energy systems, wind power systems, and farm waste energy systems. Real Property Tax Law § 487(8)(a) also authorizes a municipality to opt out of granting that property tax exemption by adoption of a local law. The Town of Putnam Valley wishes to protect the Town’s tax base by adoption of this article, which requires that solar energy systems, wind power systems and farm waste energy systems are subject to the payment of Town taxes.

§108-36: Legislative Authority

This article is enacted pursuant to Subdivision (8) of § 487 of the Real Property Tax Law of the State of New York.

§108-37: Exemption Not Permitted

Notwithstanding the provisions of Subdivision (2) of Real Property Tax Law § 487, no real property tax exemption of Town taxes shall be granted to solar energy systems, wind power systems or farm waste energy systems which began construction after the effective date of this article.

Part 4. Severability

The invalidity of any part or provision (e.g., word, section, clause, paragraph, sentence) of this Local Law shall not affect the validity of any other part of this Law which can be given effect in the absence of the invalid part or provision.

Part 6. Supersession

LOCAL LAW TO AMEND ARTICLE I OF CHAPTER 108 OF THE TOWN CODE OF THE TOWN OF PUTNAM VALLEY BY INCREASING THE INCOME THRESHOLD OF THE SENIOR CITIZEN PROPERTY TAX EXEMPTION

BE IT ENACTED, by the Town Board of the Town of Putnam Valley, Putnam County, New York, as follows:

This Local Law shall be known as the “Local Law to Amend Article I of Chapter 108 of the Town code of the Town of Putnam Valley by Increasing the Income Threshold of the Senior Citizen Property Tax Exemption”

Part 2. Enactment

This Local Law is adopted and enacted pursuant to the authority and power granted by §10 of the Municipal Home Rule Law of the State of New York.

Part 3. Amendment of the Town Code

Article I, Chapter 108: “Senior Citizens Exemption” of the Town of Putnam Valley Code is amended as follows:

Replace

§108-3 (B): All of the provisions, conditions and requirements of § 467 of the Real Property Tax Law and amendments thereto shall apply to the application for and the granting of such exemption on the assessment rolls of the Town as they apply to the Town of Putnam Valley except that no exemption shall be granted if the income of the owner or the combined income of the owners of the property for the income tax year immediately preceding the date of making application for exemption is: for the year 2023, the sum of $48,400 or more; for the year 2024, the sum of $53,400 or more; for the year 2025, the sum of $58,400 or more.

§108-3 (C): Real property owned by persons 65years or over shall be exempt from certain Town taxes up to a maximum of 50% of the assessed valuation pursuant to the following schedule:

§108-3 (D): The income of the owner or the combined income of the owners of the property for the income tax year immediately preceding the date of the application for exemption from all sources, as set forth in § 467, must be less than $48,400 for the year 2023; $53,400 for the year 2024; and $58,400 for the year 2025. “Income tax year” shall mean the twelve-month period from which the owner or owners file a federal personal income tax return or, if no such return is filed, the calendar year. When title is vested in either the husband or wife, the combined income of both may not exceed such sum.

§108-3 (E): This article shall apply to the assessment roll as follows: for §108-3(C)(1) commencing for the year 2023 and for the taxable year 2023/2024; for §108-3(C)(2) commencing for the year 2024 and for the taxable year 2024/2025; for §108-3(C)(3) commencing for the year 2025 and for the taxable year 2025/2026.

Part 4. Severability

The invalidity of any part or provision (e.g., word, section, clause, paragraph, sentence) of this Local Law shall not affect the validity of any other part of this Law which can be given effect in the absence of the invalid part or provision.

Part 5. Effective Date

  1. 100-5 Dogs – “No dogs or other animals shall be permitted to enter the beach areas or the waters of the lake abutting thereon, except for Service Dogs and dogs used by Law Enforcement personnel when actually in such service.

ADD: Definition: SERVICE DOG: A service animal is a dog that is individually trained to do work or perform tasks for a person with a disability. Any dogs found to be aggressive by the Lake Monitor, lifeguards, or staff shall be immediately removed from the beach area. Dogs must be leashed at all times. All dogs shall be registered with the Town Clerk.

  1. Generators and Air Conditioners – Generators/AC 1655-12(A)(4)(f) etc. throughout rest of all Districts. “Other customary accessory structures subject to the applicable provisions of Article VII hereof, such as playhouses, greenhouses, saunas, porches, sun decks, house decks, trash containers, outdoor air conditioners, and the like, provided that said use, building or structure is incidental t the principle use of the site”

Upon receipt of the Town Application form, a numbered registration tag will be issued by said clerk which shall be affixed to the mooring. Proof of property ownership within the District shall be required prior to the issuance of such identification tag. No more than two (2) mooring tags shall be granted for any property or properties listed under the same ownership. The registration shall be valid from the period of April 1 through March 31 of the following year. Penalties for Offenses – Anyone failing to comply with this law will be levied a $500.00 fine and face confiscation of the offending device. Subsequent offenses by the same individual or property owner will result in doubling of the preceding fine. Each week’s continued violation shall constitute a separate violation. The Code Enforcement Officer or Deputy Code Enforcement Officer shall have the authority to issue an appearance ticket pursuant to the Criminal Procedure Law (§150.20) in the enforcement of this Chapter.

DATE OF BALLOON TEST CHANGED TO MARCH 5, 2022
Due to Weather

PLEASE TAKE NOTICE that Homeland Towers, LLC (“Homeland Towers”) will perform a balloon test at 30 Porters Road, Putnam Valley, NY (the “Site”), in connection with its proposal to locate a wireless communications facility (the “Facility”) at the Site.

The Facility is proposed to include a 150foot monopole with panel antennas thereon, together
with related equipment located within a secure fenced area at the base thereof.
The balloon test will be conducted on Saturday, March 5, 2022 at the Site, or in case of inclement or windy weather, each consecutive Saturday date thereafter until the balloon test is completed. The balloon shall be flown from approximately 7:00 a.m. and 4:00 p.m. weather permitting.

The purpose of the balloon test is to establish the approximate location and height of the Facility
so that computer generated visual renderings can be prepared from various viewpoints. The balloon test will consist of an approximately threefoot diameter brightly colored balloon being floated on a tether line to a maximum height of 150 feet above ground level. A second alternate color balloon will be floated at 135 feet above ground level for evaluation purposes. Please contact the Applicants’ attorney, Robert D. Gaudioso, at 9143330700 if you should have any questions in advance of the balloon test.

ADOPTION OF RESOLUTION
DONATING 26 ACRES OF LAND TO THE HUDSON HIGHLANDS LAND TRUST

PLEASE TAKE NOTICE that the Town Board of the Town of Putnam Valley duly adopted Resolution #21-267 of 2021 at the Town Board Meeting held on November 3, 2021.

This local law is subject to a permissive referendum petition. This must be done within 45 days of the passing of this Resolution.

RESOLUTION APPROVING CONVEYANCE OF 26 ACRES OF LAND TM # 73.-1-76 TO THE HUDSON HIGLANDS LAND TRUST

RESOLUTION #21- 267

WHEREAS, the Town of Putnam Valle acquired a parcel of vacant land TM # 73.-1-76 located at Granite Mountain from the County of Putnam for no consideration; and

WHEREAS, the said parcel of vacant land is burdened by a restrictive covenant requiring that the subject parcel be preserved as open space; and

WHEREAS, the parcel of vacant land is landlocked and not otherwise suitable for development, has little or no monetary value, is not useful for Town purposes, and poses a liability risk to the Town of Putnam Valley; and

WHEREAS, the Hudson Highlands Land Trust is willing to take title to the property subject to said restrictive covenant; and, as consideration for the conveyance, agrees that the Property will be maintained and preserved as open space for scenic and natural resource protection and passive public recreation and for no other purpose; and

WHEREAS, the Town Board has determined that the above stated consideration is, under the circumstances reasonable and adequate; and

WHEREAS, this Resolution and the conveyance authorized here under is a Type II action under SEQRA;

THEREFORE BE IT RESOLVED, the Town Board hereby approves the conveyance of the 26 acre vacant parcel of land TM # 73.-1-76 to the Hudson Highlands Land Trust in accordance with the annexed “Donation Agreement”; and

BE IT FURTHER RESOLVED, that the Town Supervisor is authorized to execute the Donation Agreement and all documents necessary to convey title; and

BE IT FURTHER RESOLVED, that this Resolution and the aforesaid conveyance is subject to a Permissive Referendum and the Town Clerk shall provide the required public notice of this resolution in connection therewith.

PLEASE TAKE NOTICE that the Town Board of the Town of Putnam Valley duly adopted Local Law #8 of 2021. (see Town Website for law in its entirety)

LOCAL LAW #8 OF 2021 – A Local Law to amend the code of the Town of Putnam Valley to add Section 165.2 of the Putnam Valley Town Code to opt out of allowing cannabis retail dispensaries and on-site consumption sites as authorized under Cannabis Law Article 4.

This local law is subject to a permissive referendum petition in accordance with Cannabis Law §131 and the procedure outlined in Municipal Home Rule §24. This must be done within 45 days of the passing of this Local Law.

2022 District Budget Meeting Schedule

The Putnam Valley Town Board will hold Budget meetings to discuss the 2022 budgets for all Districts.

The Preliminary budget meeting will be held on Saturday, August 28, 2021, and the Annual Final budget meeting will be held Saturday, September 11, 2021. Both meetings will be held at Town Hall, 265 Oscawana Lake Road with a start time of 9 a.m.

PLEASE TAKE NOTICE, the Putnam Valley Town Board will conduct three (3) Public Hearings on Wednesday, July 7, 2021 as follows:

Beginning at 6:00 pm. The Town Board will be conducting a Public Hearing to hear comments on a proposed amendment to Town Code Chapter 165 adding a new Article XXIV regulating Solar Energy Systems. This new section will impose regulations on the installation of residential and commercial solar renewable energy systems and panels. The law will impose lot area and setback requirements, designate zoning districts in which commercial solar energy systems will be permitted, establish restrictions on the size and location of solar electric systems, and establish requirements for site plan approvals for such uses. (See Town of Putnam Valley.com for a copy of the law in its entirety).

IMMEDIATELY FOLLOWING the Putnam Valley Town Board will be conducting a Public Hearing on amending Town Code Chapter 165-26 through 165-26.6 – Special Provisions for County Agricultural District Properties. The purpose of this amendment is to provide special regulations with respect to the approval of farm operations and Agricultural Buildings on properties located in Agricultural Districts created under Article 25-AA of the New York State Agriculture and Markets Law and §283-a of the New York State Town Law, in recognition of § 305-a (1) of the Agriculture and Markets Law. IMMEDIATELY FOLLOWING the Putnam Valley Town Board will be conducting a Public Hearing on amending the Town Code to add Article XIX-A concerning Reimbursement of Professional Fees Incurred by the Town in Connection with Land Use Applications. This local law sets forth standards and criteria for charging and reviewing professional fees to applicants in connection with various Town land use applications. Local Law # ___ for the year 2021 Amending Parking Regulations in the Roaring Brook Lake District

BE IT ENACTED THAT A NEW SECTION 100-23-A BE ADDED TO ARTICLE 100 OF THE TOWN CODE ENACTING PARKING REGULATIONS IN THE ROARING BROOK LAKE DISTRICT STATING AS FOLLOWS:

  • 100-23A PARKING: Roaring Brook Lake District owned parking areas shall be restricted to property owners, their lessees, the members of their immediate families and their guests. Any vehicle parked in a Roaring Brook Lake District owned parking lot shall be identified by displaying a numbered Roaring Brook Lake District registration sticker or tag on its windshield, dashboard, or hanging from the rear view mirror. Any Vehicle not displaying a Roaring Brook Lake District registration sticker or tag may be removed from District Parking Lots at the owner’s expense. NO vehicle shall be parked overnight in an RBL District owned parking lot.
  • 120-3 No Parking Aqua Lane Road:

Section 120-3 of the Town Code is hereby amended to add the following provision:

Due to the extreme narrowness of Aqua Lane Road and the inability to get emergency vehicles through that road when cars are parked along the roadside, all of Aqua Lane Road will be a NO PARKING area and cars will not be permitted to park anywhere along the length of the road!

BE IT FURTHER ENACTED THAT SECTION 100-24 OF THE TOWN CODE BE AMENDED TO STATE AS FOLLOWS:

  • 100-24 Penalties for Offenses: Any person violating any of the provisions of this article shall be guilty of a violation, and upon conviction thereof, shall be punishable by a maximum fine of $250.00 or by a term of imprisonment of not more than 15 days, or both.

BE IF FURTHER ENACTED THAT SECTION 120-28 OF THE TOWN CODE BE AMENDED TO INCREASE THE MAXIMUM FINES FOR VIOLATIONS OF CERTAIN SECTIONS OF ARTICLE 120 SHALL BE AS FOLLOWS:

The maximum fine for violations of 120-3, 120-4, 120-5, 120-6, 120-7, and 120-10 shall be $50.00.

PUBLIC NOTICE IS HEREBY GIVEN that, at the time and place set forth below, the Putnam Valley Volunteer Fire Department (the “Putnam Valley Volunteer Fire Department”) and the Town of Putnam Valley (the “Town”) will conduct a public hearing for the purpose of giving interested persons an opportunity to express their views, orally or in writing, regarding the proposed issuance by the Putnam Valley Volunteer Fire Department of its Revenue Bonds, Series 2020 (“Bonds”) in a principal amount not to exceed $11,000,000.00 for the purpose of (i) paying, or reimbursing the Putnam Valley Volunteer Fire Department for paying, a portion of environmental remediation costs, hard and soft construction costs, and equipping a to-be-constructed new firehouse, consisting of approximately 29,000 gross square feet, with 5 bays and appurtenant parking (the “Project”), and (ii) paying certain costs incurred in connection with the issuance of the Bonds. The Putnam Valley Volunteer Fire Department will be the legal owner of the Project. The Project will be located on a vacant site of approximately 10.3 acres on Oscawana Lake Road known as Tax Map Number 72.20-1-7.12 located in the Town of Putnam Valley, County of Putnam, and State of New York (the “Property”), which Property is adjacent and to the south of 218 Oscawana Lake Road, Putnam Valley, New York.

Date and Time of Public Hearing: Day, September 3, 2020, at 2:00 p.m.

During the current declared state of emergency by the Governor under Executive Order No. 202.1, issued March 12, 2020, as the same may be extended due to the COVID-19 pandemic, in order to protect the health and welfare of the public in the State of New York while providing access to the operations of government, the general public may participate in the public hearing by calling the following toll-free telephone number (877) 524-1194 and use meeting I.D 137024.

Written comments may also be submitted to the Putnam Valley Volunteer Fire Department and the Town via email at information@putnamvalleyfire.com no later than 5:00 p.m. on September 2, 2020.

Documents regarding the proposed Bonds and other public records regarding the Project are in the possession of the Planning Department, Town of Putnam Valley and may be viewed in person upon request.

Any person who decides to appeal any decision made with respect to any matter considered at this hearing will need a record of the proceedings. As required by the aforementioned Executive Order, this hearing will be recorded and later transcribed and will be made available upon request to information@putnamvalleyfire.com and payment of the handling costs.

Natural Resources Inventory

The Natural Resources Inventory (NRI) of Putnam Valley has been developed to update existing maps and information on the town’s natural and cultural resources, many of which appear in the town’s Master Plan, and add additional maps, each accompanied by detailed reports. The NRI enables town officials to make important decisions for planning with consideration of all existing information, including new data researched for this project. The NRI has been developed by a working group of the town’s Commission for the Conservation of the Environment, and has included representation by the Hudson Highlands Trust, the administrator of the grants that funded this project, and the NYS DEC’s Hudson River Estuary Program. We are excited to present the completed NRI to the town at a public hearing scheduled for Town Hall on Wednesday, March 13, at 6 PM. A local law to override the tax levy limit established in General Municipal Law 3-c

Section 1. Legislative Intent

It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Putnam Valley, County of Putnam pursuant to General Municipal Law Sect. 3-c, and to allow the Town of Putnam Valley, County of Putnam to adopt a town budget for (a) town purposes (b) fire protection districts and (c) any other special or improvement district governed by the town board for the fiscal year 2019 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law Sect. 3-c.

Section 2. Authority

This local law is adopted pursuant to subdivision 5 of General Municipal Law Sect. 3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by vote of sixty percent (60%) of the town board.

Section 3. Tax Levy Limit Override

The Town Board of the Town of Putnam Valley, County of Putnam is hereby authorized to adopt a budget for the fiscal year 2019 that requires a real property tax levy in excess of the limit specified in General Municipal Law Sect. 3-c.

Section 4. Severability

If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be judged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5. Effective Date

This local law shall take effect immediately upon filing with the Secretary of State.

SUMMARY BOND RESOLUTION, DATED OCTOBER 3, 2018, AUTHORIZING, SUBJECT TO MANDATORY REFENDUM, THE ISSUANCE OF UP TO $1,900,000 AGGREGATE PRINCIPAL AMOUNT SERIAL BONDS OF THE TOWN OF PUTNAM VALLEY, COUNTY OF PUTNAM, STATE OF NEW YORK, PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE COSTS OF THE ACQUISITION OF LAND FOR THE TOWN.

WHEREAS, the Town Board of the Town of Putnam Valley (the “Town”), located in the County of Putnam, in the State of New York (the “State”), hereby determines that it is in the public interest of the Town to authorize the financing of the costs of the acquisition of land for the Town, including any preliminary and incidental costs related thereto, at a total cost not to exceed $1,900,000, all in accordance with the Local Finance Law;

NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Putnam Valley, County of Putnam, State of New York, as follows:

Section 1. There is hereby authorized to be issued serial bonds of the Town in the aggregate principal amount of up to $1,900,000, pursuant to the Local Finance Law, in order to finance the acquisition of land for the Town, including any preliminary and incidental costs related thereto (the “Project”).

Section 2. It is hereby determined that the Project is a specific object or purpose, or of a class of object or purpose, described in subdivision 21(a) of paragraph a of Section 11.00 of the Local Finance Law and that the period of probable usefulness of the Project is thirty (30) years. The serial bonds authorized in the bond resolution summarized herein shall have a maximum maturity of thirty (30) years computed from the earlier of (a) the date of the first issue of such serial bonds or (b) the date of the first issue of bond anticipation notes issued in anticipation of the issuance of such serial bonds.

Section 3. The Town Board has ascertained and hereby states that (a) the estimated maximum cost of the Project is $1,900,000; (b) no money has heretofore been authorized to be applied to the payment of the costs of the Project; (c) the Town Board plans to finance the costs of the Project from the proceeds of the serial bonds authorized in the bond resolution summarized herein, or from the proceeds of bond anticipation notes issued in anticipation of such serial bonds; (d) the maturity of the obligations authorized in the bond resolution summarized herein may be in excess of five (5) years; and (e) on or before the expenditure of moneys to pay for any costs of the Project for which proceeds of such obligations are to be applied to reimburse the Town, the Town Board took “official action” for federal income tax purposes to authorize capital financing of such item.

Section 4. Each of the serial bonds authorized by the bond resolution summarized herein and any bond anticipation notes issued in anticipation of the issuance of such serial bonds shall contain the recital of validity prescribed by Section 52.00 of the Local Finance Law. The faith and credit of the Town is hereby and shall be irrevocably pledged for the punctual payment of the principal of and interest on all obligations authorized and issued pursuant to the bond resolution summarized herein as the same shall become due. To the extent not paid from the collection of assessments against benefited properties in the Districts, an annual appropriation shall be made in each year sufficient to pay the principal and interest on such obligations becoming due and payable.

Section 5. A complete copy of the bond resolution summarized herein is available for public inspection during regular business hours at the Office of the Town Clerk, 265 Oscawana Lake Road, Putnam Valley, New York 10579 for a period of twenty days from the date of this publication.

NOTICE IS HEREBY GIVEN, that a special Town election will be held on November 6, 2018 concurrently with the general election, at which the following proposition will be submitted:

PROPOSITION

Shall the Bond Resolution, dated October 3, 2018, authorizing the issuance of $1,900,000 serial bonds of the Town of Putnam Valley to pay the cost of the acquisition of land for the Town, including any preliminary and incidental costs related thereto, at a maximum estimated cost of 1,900,000, providing the period of probable usefulness of said specific object or purpose is 30 years, and that the maximum maturity of such serial bonds may exceed five years, delegating to the Town Supervisor the power to sell and issue such serial bonds and to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance of and sale of said serial bonds, and pledging the faith and credit of said Town to the payment of the principle of and interest on such obligations, be approved ?

LOCAL LAW – COMMERCIAL TRAFFIC ON TINKER HILL ROAD

Please take notice that the Town Board of the Town of Putnam Valley duly adopted Resolution # R18-251


Whereas Tinker Hill Road connects two (2) main travel ways, Oscawana Lake Road and Peekskill Hollow Road; in the Town of Putnam Valley and;

Whereas the zoning district is for residential development and;

Whereas the intersection at Oscawana Lake Road and Tinker Hill Road has very limited sight distance for vehicular traffic and;

Whereas Tinker Hill Road has severe drop in elevation for its entire length and;

Whereas Tinker Hill Road has curves of varying radii as the elevation drops for vehicular traffic traveling from North to South and;

Whereas the road elevation does not have a level intersecting construction providing an appropriate level space for vehicles on Tinker Hill Road to brake approaching Peekskill Hollow Road and;

Whereas the minimum speed limit the Town is authorized to enact is not adequate to provide safe travel from north at Oscawana Lake Road to south to Peekskill Hollow Road.

Now Therefore, It is determined that through commercial traffic is not authorized to traverse Tinker Hill Road if it has either a tare weight of in excess of 10,000 lbs. or more than six (6) wheels. The exception is commercial vehicles providing for a local delivery at any premises on the aforesaid Tinker Hill Road.

This Town Board agrees to enact a local law prohibiting commercial through traffic for vehicles of more than 10,000 lbs. tare weight of more than six (6) wheels. Fines for violators of this local law are: $1,000.00 for the first violation and $2,000.00 for the 2nd or more violations.

The local law shall read as follows: §122-17.1(c)

Be it enacted:

The Town of Putnam Valley prohibits through commercial traffic on Tinker Hill Road. Commercial Vehicles with a tare weight in excess of 10,000 pounds or more than six (6) wheels is prohibited from traveling on Tinker Hill Road; with the exception of deliveries of addresses on Tinker Hill Road.

  • (d) Fines for first offense shall be $1,000.00.
    Fine for second or more offenses shall be $2,000.00.

Additionally the Town declares itself the Lead Agent with a Negative Declaration after having done the SEQRA.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Putnam Valley, Putnam County, New York, at a regular meeting of said Board held on May 23, 2018 duly adopted, subject to permissive referendum pursuant to Town Law Article 7, a resolution, an abstract of which is as follows:

A resolution to lease approximately 3,312 square feet of ground space, with utilities and access, at 265-273 Oscawana Lake Road, Town of Putnam Valley, County of Putnam,, State of New York and shown on the Tax Map of the Town as Section 72.16, Block 1, Lot to Homeland Towers, LLC (“Tenant”) to construct, maintain and operate a communications tower and related ancillary facilities and improvements for the transmission and reception of communication signals and to accommodate the installations of wireless carriers and Town and local emergency service antennas and equipment, including without limitation, radio equipment cabinets, antennas and related equipment and utilities. In return the Town of Putnam Valley will receive $2,000.00 per month or 35% of all gross rents collected by Tenant from subtenants, whichever is higher, paid monthly in advance. The Lease provides for a twelve month option to Lease the premises, with two additional twelve month options in exchange for a payment of $1,000.00 per option period. The initial term of the lease will be ten (10) years from the commencement date and shall automatically renew for up to nine additional terms of five years each unless Tenant notifies the Town of its intention not to renew prior to commencement of the succeeding renewal term.

Pursuant to the Resolution of the Board the validity of the Lease is subject to a permissive referendum as set forth in Article 4, section 64(2) and Article 7, section 90 of the Town Law of the State of New York.

Resolution #R16-253
That the Town Board authorize the Supervisor to sign into law the following:

Chapter 44: Smoking
Parks and Public Beaches:
  • 44.1 Purpose.
The Purpose of this article is to prohibit smoking at all Town of Putnam Valley Parks and their facilities as well as on the public beaches owned or operated by the Town of Putnam Valley, and/or any of the Town of Putnam Valley Park Districts and their facilities. The Town Board hereby finds that a potential health hazard exists from allowing smoking on said beaches both from the smoke and from the debris created by discarding cigarettes and other smoking materials.
  • 44.2 Smoking Prohibited.
The smoking or carrying of lighted cigarettes and other smoking materials, including but not limited to cigars, pipes and the like in which smoke is exhaled, at all Town of Putnam Valley parks and their facilities, as well as on the public beaches owned and operated by the Town of Putnam Valley and/or any of the Town of Putnam Valley Park Districts and their facilities is hereby prohibited.
  • 44.3
  1. Any person convicted of a violation of this article shall be guilty of a violation and punished by a warning for a first offense.
  2. Any person convicted of a second violation or more of this article shall be guilty of a violation and punished by a fine of not more than $50.00 for each offense.
  3. The Putnam County Sheriff’s Department, or any other agency, officer or employee designated by the Town Board by resolution shall be charged with the enforcement of this article.
This was signed into law on July 20, 2016 with five ayes.

RATIFICATION OF CSEA CONTRACT

The Union met today and the contract was passed by all the Union Members with the exception of one. Councilman Mackay said he wanted to thank Glenn Blackman, the Union Representative, and the members of the CSEA because this was handled in a very professional manner on both sides. We got the terms we had negotiated for. Councilwoman Annabi wanted to make sure it was being ratified at this time. Supervisor Oliverio said that it is.

RESOLVED, that the Town Board authorize the Town Supervisor to sign the Memorandum of Agreement for the Collective Bargaining Agreement with CSEA Local 840 effective January 1, 2017 to December 31, 2022.

WHEREAS, the Lake Peekskill Improvement District (the “District”) has requested that space be allocated at Carrara’s Beach for both boat storage and a boat ramp and docking;and

WHEREAS the configuration of the beach property is such that it is possible without inconvenience to the bathing facilities to set aside areas of the parcel for such boat activity;

NOW,THEREFORE, be it

RESOLVED that there shall be set aside for the storage of boats that portion of Carrara’s Beach known and designated on the tax map as Section 83.81, Block 2,Lot 1, which is on the left of the bathing area facing the lake; and be it, further

RESOLVED, that there shall be reserved for a boat ramp and docking facility at this beach on the extreme right side of the beach facing the lake known and designated on the tax map as Section 83.81, Block 2, Lot 4; and be it further

RESOLVED, that a copy of this Resolution shall be posted on the Putnam Valley website, and in Putnam Valley Town Hall, within five days following its adoption

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Putnam Valley, Putnam County, New York, at a meeting held on June 10, 2015, duly adopted the resolution published herewith, a summary of which is published herein, subject to a permissive referendum.

The resolution provides that the faith and credit of the Town of Putnam Valley, Putnam County, New York, are irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable; that an annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year; that the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds authorized by such resolution, including renewals of such notes, is delegated to the Supervisor; that all other matters, except as provided in such resolution, relating to the bonds authorized, including the date, denominations, maturities and interest payment dates, within the limitations prescribed in such resolution and the manner of the execution of the same and also including the consolidation with other issues, and the authority to issue such obligations on the basis of substantially level or declining annual debt service, is delegated to and shall be determined by the Supervisor; and that this LEGAL NOTICE shall be published.

2) Find the Manufacturer’s Brand of equipment, and click on that web link or call its toll free number.
3) Follow the instructions given by the manufacturer.

The recycling service is free to individual consumers, but not to businesses or not-for-profits with more than 50 full time employees.

NOTICE OF ADOPTION OF LOCAL LAW #2-2012

PLEASE TAKE NOTICE, that the Town Board of the Town of Putnam Valley duly adopted Local Law #2-2012 on November 8, 2012. A local law to override the limit on the amount of real property taxes that may be levied by the Town of Putnam Valley, County of Putnam pursuant to General Municipal Law Sect. 3-c, and to allow the Town of Putnam Valley, County of Putnam to adopt a town budget for (a) town purposes (b) fire protection districts and (c) any other special or improvement district governed by the town board for the fiscal year 2013 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law Sect. 3-c.

Home values increase as does the quality of life when littering and trash from trucks is reduced.

Keep Putnam Beautiful works with residents and businesses to make our area shine. They also work with schools and law enforcement. A new litter awareness campaign has been developed for high schools. It is entitled STOP the DROP.

Residents seeing someone drop litter from a vehicle or trash coming from an uncovered truck are asked to call Sheriff Smith at 225-4300. A letter will be sent by Sheriff Smith to the registered owner of the vehicle.
